By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Service Description

HMV Courier provides logistics and delivery services throughout Nigeria. Our platform connects senders with riders to facilitate the pickup and delivery of packages.

3. User Accounts

3.1 Account Creation

To use certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Responsibilities

4.1 Sender Responsibilities

As a sender, you are responsible for:

• Providing accurate information about the package and delivery details
• Ensuring the package is properly packaged and does not contain prohibited items
• Being available during the scheduled pickup time
• Paying all applicable fees for the service

4.2 Rider Responsibilities

As a rider, you are responsible for:

• Maintaining all required licenses, permits, and insurance
• Complying with all applicable laws and regulations
• Handling packages with care and delivering them in a timely manner
• Maintaining professional conduct during pickups and deliveries

5. Prohibited Items

You agree not to send or transport any of the following items through our Services:

• Illegal substances or items
• Dangerous goods, hazardous materials, or explosives
• Firearms, weapons, or ammunition
• Perishable goods that may spoil during transit
• Live animals
• Valuable items exceeding our insurance coverage limits
• Any other items prohibited by applicable law

6. Fees and Payment

The fees for our Services are displayed on our website or mobile application before you confirm your order. You agree to pay all fees associated with the Services you use. All payments are processed through secure third-party payment processors.

7. Cancellation and Refunds

Our cancellation and refund policy is as follows:

• Cancellations made before a rider is assigned may be eligible for a full refund
• Cancellations made after a rider is assigned but before pickup may be subject to a cancellation fee
• Cancellations after pickup are not eligible for a refund
• Refunds for failed deliveries or damaged packages will be evaluated on a case-by-case basis

8. Limitation of Liability

To the maximum extent permitted by law, HMV Courier shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our Services
• Any conduct or content of any third party on our Services
• Unauthorized access, use, or alteration of your transmissions or content
• Delays or disruptions in our Services
• Damage to packages during transit (subject to our insurance policy)

9. Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall be resolved through amicable negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the laws of Nigeria.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such notice constitutes your acceptance of the modified Terms.

11. Termination

We may terminate or suspend your account and access to our Services at our sole discretion, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
