1. Who We Are

HMV Courier ("HMV", "we", "us", "our") is a logistics and delivery service operated by HMV Travels and Logistics, a company registered in Nigeria with its principal office at 9A, Wing 1, Abiodun Fashakin Crescent, Behind Old LASU Building, Anthony Village, Lagos State, Nigeria. This Privacy Policy explains how we collect, use, share, and protect your personal data when you use our websites, mobile applications, business dashboard, APIs, and delivery services (together, the "Services").

We process personal data in accordance with the Nigeria Data Protection Act 2023 (NDPA) and other applicable data protection laws.

2. Information We Collect

  • Account information — name, email address, phone number, business name, and password when you create an account.
  • Shipment information — pickup and delivery addresses, recipient names and phone numbers, package descriptions, declared values, and delivery instructions.
  • Payment information — billing details and transaction records. Card payments are processed by licensed payment providers (such as Paystack or Flutterwave); we do not store full card numbers.
  • Location information — GPS location of drivers during active deliveries, and addresses you provide for pickup and delivery.
  • Device and usage information — IP address, browser type, device identifiers, pages visited, and actions taken within the Services.
  • Communications — messages, support requests, and feedback you send to us.

3. How We Use Your Information

  • To provide the Services: booking, routing, tracking, and delivering shipments.
  • To notify you about shipment status, delivery updates, and proof of delivery.
  • To process payments, issue invoices, and maintain billing records.
  • To operate business accounts, including team member access and analytics.
  • To improve our network, routes, products, and customer experience.
  • To prevent fraud, enforce our Terms of Service, and comply with legal obligations.
  • To send service communications and, where you have consented, marketing messages (you can opt out at any time).

4. Legal Bases for Processing

We process personal data where it is necessary to perform a contract with you (delivering your shipments), where we have a legitimate interest (securing and improving the Services), where you have given consent (marketing), and where processing is required by law (tax and regulatory records).

5. Sharing Your Information

We do not sell your personal data. We share it only with:

  • Delivery personnel and hub operators — the details needed to complete a pickup or delivery (names, addresses, phone numbers, package information).
  • Recipients and senders — limited shipment status information visible through tracking.
  • Payment providers — to process transactions securely.
  • Service providers — hosting, analytics, SMS/email delivery, and mapping providers who process data on our instructions.
  • Business account administrators — if you use the Services under a business account, your organisation's administrators can see shipments created under that account.
  • Authorities — where required by law, court order, or to protect rights, safety, and property.

6. Data Retention

We keep personal data for as long as your account is active and as needed to provide the Services, resolve disputes, and meet legal, tax, and audit obligations. Shipment and transaction records are retained for a minimum of six (6) years in line with Nigerian regulatory requirements, after which they are deleted or anonymised.

7. Security

We use administrative, technical, and physical safeguards to protect your data, including encryption in transit, access controls, and audit logging. No system is completely secure; if we become aware of a breach affecting your personal data, we will notify you and the Nigeria Data Protection Commission as required by law.

8. Your Rights

Subject to applicable law, you have the right to access, correct, delete, or receive a copy of your personal data; to object to or restrict certain processing; and to withdraw consent at any time. To exercise these rights, contact us using the details below. You also have the right to lodge a complaint with the Nigeria Data Protection Commission.

9. Cookies

Our websites use cookies and similar technologies to keep you signed in, remember preferences, and understand how the Services are used. You can control cookies through your browser settings; disabling them may limit some functionality.

10. Children

The Services are not directed at children under 18, and we do not knowingly collect personal data from them. Shipment recipient details may include any consenting adult designated by the sender.

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and HMV Travels and Logistics, the operator of the HMV Courier brand, websites, applications, dashboard, APIs, and delivery services (the "Services"). By creating an account, booking a shipment, or otherwise using the Services, you agree to these Terms. If you use the Services on behalf of a business, you confirm you are authorised to bind that business.

2. The Services

HMV provides logistics services throughout Nigeria, including courier delivery, business shipping, warehousing, fleet management, shipment tracking, and developer APIs. Service availability, coverage areas, and delivery timeframes vary by location and are shown at the time of booking. Estimated delivery times are estimates, not guarantees.

3. Accounts

  • You must provide accurate, current information and keep your credentials secure.
  • You are responsible for all activity under your account, including activity by team members you invite to a business account.
  • We may suspend or terminate accounts that violate these Terms, abuse the Services, or present fraud or safety risks.

4. Shipments

  • Accurate declarations. You must accurately describe every shipment, including contents, weight, dimensions, and declared value.
  • Prohibited items. You may not ship illegal goods, dangerous or hazardous materials, firearms, ammunition, illicit drugs, perishables not agreed in advance, cash, live animals, or any item whose carriage would violate Nigerian law. We may open and inspect any shipment we reasonably suspect breaches this clause and may refuse, hold, or hand over such shipments to authorities.
  • Packaging. You are responsible for adequate packaging. We are not liable for damage resulting from insufficient packaging.
  • Delivery. Delivery is complete when the shipment is handed to the recipient, a person at the delivery address, or as otherwise instructed by the sender (including safe-drop instructions), with digital proof of delivery recorded.
  • Failed delivery. If delivery fails after reasonable attempts, we will contact you to arrange redelivery or return; additional fees may apply. Unclaimed shipments may be disposed of after 90 days in accordance with applicable law.

5. Fees and Payment

Fees are shown at booking or agreed in your business contract. Fees are payable in Nigerian Naira unless otherwise agreed. Late payment on business invoices may incur interest and suspension of the Services. Quotes derived from inaccurate shipment declarations may be re-rated to reflect actual weight, dimensions, or service used.

6. Liability for Shipments

Unless a higher protection level is purchased or agreed in writing, our liability for loss of or damage to a shipment is limited to the lesser of the declared value or ₦50,000 per shipment. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, revenue, or business opportunity. Claims must be reported within 7 days of delivery (for damage) or expected delivery (for loss), with supporting evidence.

We are not liable for delay, loss, or damage caused by events beyond our reasonable control, including weather, road conditions, civil unrest, strikes, regulatory action, or force majeure.

7. Business Accounts and APIs

  • Business dashboards, team management, analytics, and invoicing are provided under the plan or contract agreed with your organisation.
  • API keys are confidential. You are responsible for calls made with your keys and must not exceed agreed rate limits or use the APIs to build a competing delivery network.
  • We may modify or deprecate API endpoints with reasonable notice through the developer documentation at api.hmvcourier.com/docs.

8. Acceptable Use

You may not use the Services to break the law, infringe the rights of others, interfere with the operation of the network, reverse engineer our software, scrape data without permission, or misrepresent your identity. We may investigate and take appropriate action, including suspension and referral to law enforcement.

9. Intellectual Property

The Services, including software, branding, and content, are owned by HMV Travels and Logistics or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose. No other rights are granted.

10. Termination

You may stop using the Services at any time. Either party may terminate a business contract in accordance with its terms. Sections relating to fees owed, liability, intellectual property, and disputes survive termination.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Services or by email, and the updated Terms take effect on the date stated. Continued use of the Services after that date constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. We encourage you to contact us first so we can try to resolve any issue quickly. Disputes that cannot be resolved amicably are subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
